
Proposed Ordinance Update for
Business Short-Term Rentals
Sec 10-___:
(a) Definitions – Sec.10-242 shall be amended to include:
(1) Change of ownership – Any sale, conveyance, or other transfer of any portion of ownership or control from the grantor(s) to a grantee(s) who is other than only the grantor(s), including but not limited to a sale, conveyance, or other transfer where the original or new owner is an individual, corporation, partnership, limited liability company, trust, land contract or other entity.
(2) Extended block – The property abutting two sides of a street and lying between the two nearest intersecting streets (crossing or terminating); or between the nearest such street and railroad right-of-way, unsubdivided acreage, lake, river, or live stream; or between any of the foregoing and any other barrier to the continuity of development, or corporate boundary lines of the municipality. (e.g., the 300s block of Erie Street, would be described as the area including the homes facing Erie Street on the north and south sides of Erie Street, bounded on the west and east by Indiana Avenue and Kalamazoo Street, respectively.)
(3) Short-term Rental Business Unit – A zoning use as defined in Zoning Ordinance Section 201.19.
(b) The total number of Short-term Rental Business Units that may be registered to operate in the City shall be no more than 250, excluding Short-term Rental Business Units pursuant to Zoning Ordinance Section 1743(c)(3).
(c) A Short-term Rental Business Unit may be located in the residential districts R-1A, R-1B, R-1C, and R-2 if it complies with the following regulations:
(1) No more than two Short-term Rental Business Unit registration permits shall be issued per Extended Block.
(2) The Short-term Rental Business Unit meets all the other requirements of the Zoning Ordinance and City Code.
(d) Existing Short-term Rental Business Unit Registration Permits. Short-term Rental Business Unit registration permits issued per Sec. 10-243 and active as of the effective date of this Sec. 10-___ will continue in effect, subject to applicable annual review requirements for residential properties and meeting all other requirements under Article X, Chapter 10 and Zoning Ordinance Section 1743.
(e) A Short-term Rental Business Unit registration permit (whether existing upon enactment of Sec. 10-___, or later issued) is non-transferable and lapses upon the earlier of the date:
(1) A change of ownership occurs of the dwelling unit for which the registration permit was issued, or
(2) An active registration permit fails to comply with all requirements of Article X, Chapter 10 and Zoning Ordinance Section 1743, including, but not limited to, failure to obtain an annual permit before the permit from the previous year expires.
(f) Until the total number of registered Short-term Rental Business Units falls below 250 pursuant to subsection (b), the City shall not issue any new Short-term Rental Business Unit registration permit, including but not limited to any permit requesting a temporary hardship waiver pursuant to Zoning Ordinance Section 1743(f).
(g) This Ordinance shall control if there are any inconsistencies with any other City Code or Zoning Ordinance.
